Buyer-side and seller-side closing costs for a Florida residential transaction. Defaults follow standard Florida conventions — buyer pays lender's title insurance, seller pays owner's title insurance (except in Miami-Dade and Broward, where the buyer typically pays both). Are these costs negotiable?
Some are. The contract specifies who pays what — defaults follow Florida convention but the parties can negotiate. Seller concessions (seller pays a portion of buyer closing costs) is common. Lender fees are sometimes shoppable. Title insurance rates are state-promulgated and not negotiable.
Why is Miami-Dade different?
Convention. There's no legal requirement, but custom in Miami-Dade and Broward is for the buyer to pay the owner's title insurance. Elsewhere in Florida, the seller pays it. Real estate contracts default to the local convention but can be modified.
